The Misuse of Slots Enforcement Code 2008 (the Code) includes a requirement for Airport Coordination Limited (ACL) to consult every 2 years on the effectiveness of the Code in discouraging the misuse of slots at coordinated airports in the UK.
On 7 June 2010 ACL published to the industry and to key stakeholders a consultation paper containing proposed revisions to the Code and inviting responses from key stakeholders by the deadline for responses – 5 July 2010.
The key questions covered in the consultation are:
• How to address air carriers ‘tolerance’ to the level of fines currently applied by ACL to discourage slot misuse?
• How to encourage air carriers to pay fines promptly by providing an incentive?
• How the cost of the operation of the Code should be shared between the operators of the coordinated airports in the UK?
• Whether the consultation on changes to the Code should take place every 3 years rather than every 2 years (with a provision for urgent consultations when it becomes necessary)?
